1. Service
Captou is a B2B prospecting platform operated by Wizz! comms, offering lead extraction from public sources, data enrichment, and outreach tools via WhatsApp and email. Access is subject to account creation, acceptance of these Terms, and payment of the applicable subscription.
2. Credits and billing
Credits are consumed by successful extractions and CNPJ lookups. Unused credits do not roll over between monthly billing cycles. Annual subscriptions are charged in full at the start of the period. Access is immediately activated upon payment confirmation.
3. Cancellation and refunds
Monthly subscriptions may be cancelled at any time, taking effect at the end of the current billing period. Customers in Brazil are entitled to a full refund if cancellation is requested within 7 calendar days of the first purchase (Consumer Protection Code, art. 49). For annual subscriptions cancelled after 7 days, we apply a pro-rata refund for remaining months, minus credits already consumed. Refund requests must be sent to support@wizzcomms.com.
4. User obligations
You agree to: use the service in compliance with LGPD, GDPR, and applicable local law; obtain necessary consent before contacting extracted leads; keep your access credentials secure; and promptly notify us of any unauthorised use of your account.
5. Acceptable use
You may not: use the platform for spam, phishing, or misleading communications; extract data for illegal or discriminatory purposes; share account access with unauthorised third parties; attempt to circumvent rate limits or security mechanisms; or reverse-engineer the extraction logic.
6. Intellectual property
The Captou software, design, and brand are the exclusive property of Wizz! comms. Leads generated through the platform belong to the user who extracted them, within the limits of applicable data protection law. The user grants Wizz! comms a non-exclusive licence to process that data solely for the purpose of delivering the contracted service.
7. Suspension and termination
We may suspend or terminate access in the event of: violation of these Terms; fraudulent or illegal activity; non-payment after 7 days' notice; or a request from competent authorities. In serious cases, termination may be immediate. You will be notified by email and will have 15 days to export your data, unless prohibited by law.
8. Liability
The service is provided without guarantees of continuous availability, as it depends on third-party sources and APIs. Wizz! comms is not liable for inaccuracies in data extracted from public sources, interruptions to third-party services (Stripe, Meta, Apify), or indirect damages arising from use of the platform. Wizz! comms' total liability is limited to the amount paid by you in the previous 12 months.
9. Changes to terms
We may update these Terms with 30 days' advance notice by email and in-platform notification. Continued use after the effective date constitutes acceptance of the new Terms. In the event of materially adverse changes, you may cancel without penalty within the notice period.
10. Governing law and jurisdiction
These Terms are governed by Brazilian law. Any dispute shall be submitted to the courts of the city of São Paulo, Brazil. For users in the European Union, the rights conferred by the GDPR and applicable local consumer protection law also apply.
